Privacy Policy

1.1 Controller. DesignAvixo, registered at 214 67 ALBINSROGATAN 1B, MALMÖ, Sweden, is the data controller for all personal data processed through this website. Contact: [email protected].

1.2 Data Collected. We collect personal data you voluntarily provide via contact forms, including your name, email address, and project brief details. We also collect standard server log data (IP address, browser type, pages visited) and functional cookie identifiers.

1.3 Purpose of Processing. Personal data is processed for: (a) responding to your project inquiries and delivering contracted services; (b) maintaining accurate business records; (c) complying with applicable Swedish and EU tax, accounting, and commercial regulations; and (d) improving website functionality through aggregated analytics.

1.4 Legal Basis. Processing is based on: (a) Article 6(1)(b) GDPR — performance of a contract or pre-contractual steps taken at your request; (b) Article 6(1)(c) GDPR — compliance with a legal obligation; and (c) Article 6(1)(f) GDPR — legitimate interest in improving our services and website experience.

1.5 Data Retention. Contact form submissions are retained for 24 months from the date of submission. Contract-related data is retained for the duration of the engagement plus 7 years in compliance with Swedish bookkeeping requirements (Bokföringslagen 1999:1078).

1.6 Third-Party Processors. We share data with: (a) Google LLC (Google Maps — embedded map service, subject to Google's privacy policy); (b) our hosting provider for server infrastructure; and (c) payment processors solely for handling financial transactions via Stripe.

1.7 Your Rights. Under GDPR, you have the right to access, rectify, erase, restrict processing, object to processing, and port your personal data. To exercise these rights, contact [email protected]. You also have the right to lodge a complaint with the Swedish Data Protection Authority (Integritetsskyddsmyndigheten).

1.8 International Transfers. Where data is transferred outside the EEA, we rely on Standard Contractual Clauses approved by the European Commission to ensure adequate protection.

Terms of Service

2.1 Scope. These Terms govern all services provided by DesignAvixo, registered at 214 67 ALBINSROGATAN 1B, MALMÖ, Sweden, to its clients. By engaging our services, you agree to these Terms in their entirety.

2.2 Service Agreement. All engagements begin with a mutually signed Statement of Work (SOW) that defines project scope, deliverables, timelines, and fees. These Terms supplement, but do not replace, the specific terms of each SOW.

2.3 Intellectual Property. Upon full payment, all design deliverables, prototypes, specifications, and design system components created under a SOW are assigned to the client. DesignAvixo retains the right to display anonymized project examples in its portfolio unless explicitly restricted in the SOW.

2.4 Payment Terms. Invoices are issued per the schedule defined in the applicable SOW. Payment is due within 14 days of invoice date. Late payments incur interest at the statutory rate under Swedish Räntelagen (1975:635). Work may be paused for accounts overdue beyond 30 days.

2.5 Limitation of Liability. DesignAvixo's total aggregate liability under any SOW shall not exceed the total fees paid by the client for the specific project giving rise to the claim. We are not liable for indirect, consequential, or incidental damages.

2.6 Confidentiality. Both parties agree to keep confidential all proprietary information exchanged during the engagement. This obligation survives termination for a period of 24 months.

2.7 Termination. Either party may terminate a SOW with 14 days written notice. Upon termination, the client is invoiced for all work completed up to the termination date. Prepaid amounts for uncompleted work are refunded within 30 days.

2.8 Governing Law. These Terms are governed by the laws of Sweden. Disputes shall be resolved by the courts of Malmö, Sweden.

Cookie Policy

3.1 What Are Cookies. Cookies are small text files placed on your device by websites you visit. They are widely used to enable website functionality, improve user experience, and provide analytical data to site operators.

3.2 Cookies We Use. DesignAvixo uses only strictly necessary functional cookies: (a) cookie_accepted — a localStorage flag that records your cookie consent preference and prevents the consent banner from reappearing on subsequent visits. This cookie stores no personal data and expires only when you clear your browser storage.

3.3 Third-Party Cookies. Embedded Google Maps may set cookies when loaded on our contact page. These are governed by Google's privacy policy and are not under our direct control. We do not use advertising, tracking, or remarketing cookies.

3.4 Managing Cookies. You may disable cookies through your browser settings at any time. Disabling strictly necessary cookies may impair certain website functionalities but will not affect core navigation or form submission.

3.5 Changes. This Cookie Policy may be updated to reflect changes in our practices. The "Last Updated" date at the top of this page indicates the most recent revision.

Refund & Reimbursement Policy

4.1 Pre-Project Deposits. A deposit of 40% of the quoted project fee is required before work commences. This deposit is fully refundable if DesignAvixo is unable to begin work within 10 business days of the agreed start date for reasons solely attributable to DesignAvixo.

4.2 Work-in-Progress. If a client terminates a project after work has begun, the deposit is non-refundable. Additional payments for completed work milestones are invoiced and payable in full. Any prepaid amounts for uncompleted future milestones are refunded within 30 days of termination notice.

4.3 Deliverable Disputes. If a delivered milestone does not materially conform to the specifications defined in the SOW, the client must notify DesignAvixo in writing within 7 business days of delivery. DesignAvixo will remediate non-conforming deliverables at no additional charge within a reasonable timeframe. If remediation is not possible, a partial refund proportional to the non-conforming scope will be issued.

4.4 Refund Process. Approved refunds are processed to the original payment method within 14 business days. Clients will receive email confirmation once a refund has been initiated. DesignAvixo is not responsible for delays caused by the client's financial institution.

4.5 Non-Refundable Items. Completed and delivered design specifications, prototype files, and design system documentation are non-refundable once accepted by the client in writing or via the project management platform. This does not affect your statutory rights under EU consumer protection directives where applicable.
